SALES THROUGH GUMROAD

Purchase, Licensing & Digital Delivery

Cue Control PRO is currently sold through Gumroad. Gumroad acts as Merchant of Record for the transaction and handles payment processing, applicable indirect taxes, transaction risk/fraud functions and related checkout services under Gumroad's own terms and privacy information.

Proseniq remains the publisher and licensor of Cue Control. After a qualifying Gumroad purchase, Proseniq may receive or retrieve the limited purchase information needed to assign and administer the software license, including the buyer email address and Gumroad sale ID. The details and legal bases are described in the Cue Control Privacy Policy.

The Cue Control PRO Gumroad checkout is configured to require acceptance of the applicable Cue Control EULA and, where relevant for immediate supply of digital content, a separate express request/acknowledgement concerning immediate digital delivery and statutory withdrawal rights. Mandatory consumer rights remain unaffected.

LIVE USE

Important Live-Use Notice

Cue Control is independent show-control and media-playback software intended primarily for professional or technically skilled users.

Cue Control is not a certified safety-critical, emergency, life-safety or fail-safe system. It must not be relied upon as the sole or primary safety control where software failure, delayed execution, unintended execution or loss of control could cause death, personal injury, significant physical property damage or environmental harm.

For live, commercial, theatre, broadcast, touring, venue or installation use, the operator should test the complete project and system, rehearse show-critical cues, maintain independent backups and use appropriate redundancy, manual fallbacks and qualified supervision.

BETA / PRE-RELEASE

Beta Builds

A build identified as Beta, preview or pre-release is supplied for evaluation and testing and may contain known or unknown defects. Beta builds are not recommended as the sole production/live system. Anyone choosing to use a Beta build live should maintain an independently tested stable fallback.

RIGHTS & LIABILITY

Warranty, Consumer Rights & Professional Use

To the maximum extent permitted by applicable law, Cue Control is provided “as is”, “with all faults” and “as available” without a guarantee of uninterrupted, error-free or universally compatible operation. Nothing removes mandatory consumer conformity, update, refund, product-liability or other non-waivable rights.

The EULA contains the detailed professional/business liability provisions, mandatory carve-outs and consumer protections. Cue Control's contractual limitations do not exclude statutory product liability that cannot legally be excluded.

THIRD-PARTY SYSTEMS

Compatibility Depends on the Complete System

Operating systems, computers, audio/video devices, drivers, codecs, networks, MIDI, OSC, MTC, Art-Net equipment and other third-party systems are outside the Publisher's control. Compatibility and timing behavior may change when those systems are updated or reconfigured.

PRIVACY & SECURITY

Privacy and Security Reporting

The Cue Control activation system uses pseudonymous technical identifiers and does not transmit the plaintext license serial in the activation request. The complete online privacy notice describes the data, purposes, legal bases and retention rules in detail.

CONTRACTUAL TERMS

Complete Terms

The complete contractual terms are contained in the End User License Agreement and, during Windows installation, in the installer license agreement. If this notice conflicts with the EULA, the EULA applies, subject to mandatory law.

Publishing these legal pages does not replace the contractual steps at checkout. The current Cue Control PRO Gumroad checkout separately presents the EULA acceptance and the immediate-supply / withdrawal acknowledgement described above. Purchase records and licensing data are handled in accordance with the applicable Gumroad terms and the Cue Control Privacy Policy.
